Agreement to Terms
By accessing or using MySpotify (“us”, “we”, or “our”) and the myspotify.me website (the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you disagree with any part of these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and MySpotify. Please read these Terms carefully before using our Service.
Description of Service
MySpotify is an AI-powered playlist generation service that allows users to create personalized Spotify playlists based on text prompts, mood descriptions, or listening history analysis. The Service integrates with Spotify's API to access your account and create playlists on your behalf.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you.
User Accounts and Registration
Account Requirements
To use our Service, you must:
- Be at least 13 years of age
- Have a valid Spotify account
- Provide accurate and complete information when registering
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
Account Responsibility
You are responsible for all activities that occur under your account, including any playlists created, credits used, or payments made. You agree to keep your account information secure and confidential.
Payment Terms and Credits
Credit System
Our Service operates on a credit-based system. Credits are required to generate playlists. New users receive 3 free credits upon first login. Additional credits can be purchased through our pricing plans.
Payment Processing
All payments are processed securely through Stripe. By making a purchase, you agree to:
- Provide accurate payment information
- Authorize us to charge your payment method
- Pay all applicable fees and taxes
Refund Policy
Credits are non-refundable once purchased and used. Unused credits do not expire but are tied to your account. Refunds may be considered on a case-by-case basis for technical issues that prevent you from using the Service. Contact us at ask@myspotify.me to request a refund.
Pricing Changes
We reserve the right to modify our pricing at any time. Price changes will not affect credits already purchased or in your account.
Acceptable Use Policy
You agree not to use the Service:
- For any unlawful purpose or to solicit others to perform unlawful acts
- To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information or prompts containing illegal, offensive, or inappropriate content
- To upload or transmit viruses or any other type of malicious code
- To collect or track the personal information of others without their consent
- To spam, phish, pharm, pretext, spider, crawl, or scrape content
- For any obscene or immoral purpose or to interfere with or circumvent the security features of the Service
We reserve the right to terminate your account and access to the Service immediately, without prior notice, for any violation of this Acceptable Use Policy.
Intellectual Property Rights
Service Content
The Service and its original content, features, and functionality are owned by MySpotify and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Generated Playlists
Playlists generated through our Service are created in your Spotify account and belong to you. However, you acknowledge that:
- The AI-generated song selections are suggestions based on your prompts
- Individual songs remain the property of their respective copyright holders
- You are responsible for ensuring your use of generated playlists complies with Spotify's terms of service
User Content
By submitting prompts, feedback, or other content to our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process such content solely for the purpose of providing and improving our Service.
Third-Party Services
Spotify Integration
Our Service integrates with Spotify's API. By using our Service, you agree to comply with Spotify's Terms of Service. You are responsible for maintaining your Spotify account in good standing. We are not responsible for any issues arising from your Spotify account, including account suspension or termination.
AI Services
Our Service uses OpenAI's API to generate playlist recommendations. We do not guarantee the accuracy, quality, or appropriateness of AI-generated content. Song recommendations are provided “as is” and may not always match your expectations.
Payment Processing
Payments are processed by Stripe. By making a purchase, you also agree to Stripe's Terms of Service.
Service Availability and Modifications
We strive to provide continuous access to our Service but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:
- Maintenance or updates
- Technical issues or failures
- Third-party service outages (Spotify, OpenAI, Stripe)
- Force majeure events
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any loss or damage resulting from such actions.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSPOTIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, trojan horses, or similar items transmitted through the Service
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service
- Third-party service failures (Spotify, OpenAI, Stripe)
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:
- The Service will meet your requirements or expectations
- The Service will be uninterrupted, timely, secure, or error-free
- AI-generated playlists will be accurate, appropriate, or to your liking
- Any errors in the Service will be corrected
Account Termination
Termination by You
You may terminate your account at any time by disconnecting your Spotify account or contacting us at ask@myspotify.me. Upon termination, your access to the Service will cease, but playlists already created in your Spotify account will remain.
Termination by Us
We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice, if you:
- Violate these Terms or our Acceptable Use Policy
- Engage in fraudulent, abusive, or illegal activity
- Fail to pay any fees owed to us
- Use the Service in a manner that could harm us or other users
Upon termination, your right to use the Service will immediately cease. We may delete your account data, but playlists created in your Spotify account will remain unless you delete them.
Indemnification
You agree to defend, indemnify, and hold harmless MySpotify, its officers, directors, employees, and agents from and against any claims, actions, suits, or proceedings, as well as any losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including Spotify or copyright holders
- Any content you submit or prompts you provide
Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
Dispute Resolution Process
If you have any concerns or disputes about the Service, please contact us first at ask@myspotify.me to attempt to resolve the issue. We will make good faith efforts to resolve any disputes within 30 days.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MySpotify regarding the use of the Service and supersede all prior agreements and understandings.

Acknowledgment
BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SERVICE.
